Common Order:
Writ Petition No.26623 of 2014 is filed for a Mandamus to declare the action of respondent No.4- Assistant Director of Mines & Geology in not issuing transport permits to the petitioner, as illegal and arbitrary.
Contempt Case No.1381 of 2014 is filed alleging willful disobedience of Order, dated 14-08- 2013, in WP.No.22447 of 2013, by the respondent (respondent No.4 in WP.No.26623/14) (hereinafter referred to as ‘the respondent’).
Both these cases were heard in detail on 14- 11-2014. After such hearing, the cases were adjourned at the request of the learned Special Government Pleader to enable the respondents to take corrective steps.
Today, the learned Special Government Pleader placed before the Court letter No.2214/Q/2003, dated 18-11-2014, addressed by the respondent to the petitioner wherein he has informed the latter that his earlier letter, dated 02.09.2014, has been withdrawn. The learned Special Government Pleader has also filed a copy of Form - L pertaining to dispatch permit of minor minerals issued to the petitioner on 19-11-2014.
Mr.V.Jagapathi, learned Counsel for the petitioner, submitted that with the withdrawal of his earlier letter and issue of dispatch permit by the respondent, the petitioner’s grievance stands redressed. He has also submitted that as the respondent has forwarded the petitioner’s application to the Deputy Director, Mines and Geology (respondent No.3 in WP.No.26623/14), the cause in the Writ Petition does not survive for adjudication.
The learned Special Government Pleader submitted that the Deputy Director of Mines and Geology will consider the petitioner’s application for renewal of lease and dispose of the same on merits.
In the light of the above submissions of the learned Counsel for both the parties, both the Contempt Case and the Writ Petition stand disposed of.
As a sequel, miscellaneous petitions, pending if any, stand disposed of as infructuous.
