JUDGMENT / ORDER

Writ Petition has been filed praying to issue a Writ of Certiorarified Mandamus calling for the records relating to the Seniority List prepared by the 2nd respondent dated as on 01.01.2011 for the post of Head Master of a Middle School and quash the same only in so far as it relates to the petitioners and consequently direct the respondents 1 and 2 to re-fix the Seniority of the Petitioners above their Juniors namely, Respondents 3 to 13.
2. It is the case of the petitioners is that they are entitled to seniority far above the Juniors namely respondents R3 to R13. Therefore, they requested the second respondent to refix their seniority of the petitioners above their juniors namely, Respondents 3 to 13. The petitioners' request seeking promotion to the post of Headmaster of Middle School was rejected by the second respondent. Therefore, challenging the said order, the present writ petition has been filed and consequently, seeking a prayer to refix the seniority of the petitioners above their Juniors namely, Respondents 3 to 13.

Mr.R.Govindasamy, learned Special Government Pleader appearing for the respondents represented that the similar cases to that of the writ petitioners came up before the Madurai Bench of Madras High Court in W.P.(MD) Nos.8755 to 8952 of 2010 and by order dated 18.11.2010, the said claim made by the writ petitioners therein were negatived and the writ petitions were dismissed on 18.11.2010. This writ petition is squarely covered by the above decision of Madurai Bench of Madras High Court and these petitioners are not entitled to re-fixation of seniority above their Juniors namely Respondents 3 to 13.
4. On perusal of the order in W.P.(MD) Nos.8755 to 8952 of 2010, dated 18.11.2010 it is made clear the same is squarely applicable to the case of the petitioners. Therefore, the writ petitioners are not entitled for the prayer sought for in this writ petition.
5. Accordingly, the writ petition is dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
