ORDER:
This Writ Petition is filed for a mandamus to declare the action of respondent No.2 in not allotting the essential commodities to the petitioner for supply of the same to the card holders of Fair Price Shop No.2, of Sreeramulapeta village, Yerraguntla Mandal, Kadapa District, as illegal and arbitrary.
On 3-12-2014, this Court passed the following order :
“Despite the order passed by this Court staying the termination of the petitioner’s fair price shop authorization, respondent No.2 has allegedly withheld stocks to the petitioner purportedly on the ground that proceedings under Section 6-A of the Essential Commodities Act, 1955, have been initiated, based on a fresh inspection made on 13-10- 2014.
Prima facie, this Court feels that the respondents are after the petitioner. Respondent No.2 is directed to be personally present on the next date of hearing along with relevant record and explain his action.
Post on 8-12-2014.”
In compliance with the direction of this Court, respondent No.2 is personally present. He has placed before the Court the allotment details of the essential commodities for the month of December 2014 which show that the petitioner’s fair price shop was allotted the essential commodities for the said month. Respondent No.2 has also assured that he will continue to allot stock to the petitioner so long as her authorization continues to subsist.
In view of the above, the Writ Petition is disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.46326 of 2014 filed for interim relief is disposed of as infructuous.
