On 24.4.2018, Sri Dhananjay Awasthi was granted time to obtain instructions as to whether NCTE before reducing the intake from 100 to 50 seats, by issuing corrigendum, ever put the petitioner to notice. He was also required to inform the Court as to whether the corrigendum was communicated to the petitioner or not.
Today, when the matter is taken up, Sri Dhananjay Awasthi admits that before reducing intake from 100 to 50 seats by issuing the impugned corrigendum, no notice was issued to the petitioner. However, according to him, the corrigendum was communicated to the petitioner. He very fairly stated that since no notice was issued to the petitioner nor its version could be ascertained before issuing the corrigendum, therefore, the respondent is prepared to pass a fresh order in that regard, after hearing the petitioner.
In view of the said statement made by Sri Dhananjay Awasthi, the impugned corrigendum dated 14.6.2016 is quashed, leaving it open to the respondent to pass a fresh order, after due notice and opportunity of hearing to the petitioner.
At this stage, counsel for the petitioner submitted that the petitioner would submit its reply before the NCTE within three days by treating the impugned corrigendum as show cause notice.
Sri Dhananjay Awasthi states that NCTE would pass a fresh order, after taking into consideration the representation filed by the petitioner, within next ten days.
The petition stands disposed of in terms of the statement made by learned counsel for the parties.
