THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28388 of 2014 ORDER :
The petitioner claims to be the owner of Plot No.136 in Survey No.124 of Kallur Revenue Village, 76 Ward of Kurnool Municipality. The petitioner instituted this writ petition contending that when the document was presented for registration before the Joint Sub-Registrar, Kurnool (2nd respondent), the 2nd respondent refused to receive the same. However, no date is mentioned as to when the document was presented by the petitioner before the 2nd respondent. The document which the petitioner seeks to register is of the year 2012.
2. Apparently, as the petitioner has not presented the document, no declaration can be given as sought by the petitioner. Hence, the writ petition is disposed of giving liberty to the petitioner to present the deed of conveyance of the above stated property. As and when such document is received the 2nd respondent shall process the same in accordance with Indian Registration Act, 1908 and Indian Stamp Act, 1899. If the 2nd respondent is of the opinion that the document presented by the petitioner cannot be registered, he shall assign due reasons and communicate the same to the petitioner within a period of three weeks from the date of receipt of such document. There shall be no order as to costs.
3. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
