Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the respondents to dispose of the petitioner's representation dated 21.03.2017 with regard to conducting a survey and laying the boundary stones at Ward H, Block No.16, T.S.No.249 Part, situated within the Municipal Corporation Limits of Thirupur.
For Petitioners : Mr.V.Chinnasamy For Respondents : Mr.R.Rajeswaran Spl. Govt. Pleader O R D E R Mr.R.Rajeswaran, learned Special Government Pleader, takes notice for the respondents. By consent, the main writ petition itself is taken up for disposal at the admission stage itself.
2. The petitioners have filed the above writ petition to issue a Writ of Mandamus directing the respondents to dispose of their representation dated 21.03.2017 with regard to conducting a survey and laying the boundary stones at Ward H, Block No.16, T.S.No.249 Part, situated within the Municipal Corporation Limits of Thirupur.
3. The learned counsel appearing for the petitioners submitted that in spite of petitioners' representation dated 21.03.2017 to survey and demarcate the petitioners' land, the respondents 2 and 3 have not completed the exercise so far.
4. Mr.R.Rajeswaran, learned Special Government Pleader, appearing for the respondents submitted that the respondents 2 and 3 may be directed to consider the petitioners' representation dated 21.03.2017, for surveying and demarcating the petitioners' land and pass orders, in accordance with law, after giving notice to all the interested parties.
5. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the respondents 2 and 3 to consider the petitioners' representation dated 21.03.2017, for surveying and demarcating the petitioners' land, and pass orders, in accordance with law, after giving notice to all the interested parties, within a period of eight weeks, from the date of receipt of a copy of this order.
With this observation, the writ petition is disposed of. No costs.
