For Petitioner : Ms.T.Aananthi For R1 : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the first respondent to take action pursuant to FIR in Crime No.464 of 2015 against the second respondent.
2. The case of the petitioner is that as against the second respondent herein, he has lodged a complaint with the first respondent and the same was registered as FIR in Crime No.464 of 2015 for the offences punishable under Sections 406 and 420 IPC, pursuant to the direction of this Court dated 21.04.2015 in Crl.OP No.10051 of 2015. Apprehending arrest in connection with the said case, the second respondent approached this Court seeking anticipatory bail on three occasions, which were ultimately, dismissed. During the interregnum period, the wife of the second respondent had also given an undertaking in writing dated 05.09.2015, promising to repay the amount involved in the matter, however, she failed to honour the same. Finding no action on the complaint made by the petitioner, he has come up with the present petition for the above stated relief.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondent.
4. Considering the facts and circumstance of the case, this Court directs the first respondent police to complete the investigation in Crime No.464 of 2015 pending on his file and file a final report within a period of four weeks from the date of receipt of a copy of this order. This Criminal Original Petition is disposed of accordingly.
