Venkateshwara Market Avenue Road Bengaluru – 560 002. … Respondent (By Sri V.B.Shivakumar, Advocate) This CRP is filed under Section 18 of Small Causes Court Act praying to set aside the judgment and decree dated 21.04.2016 passed in SC No.2825/2011 on the file of the XIII Additional Small Cause Judge, Member MACT, Bengaluru, SCCH NO.15, in so far as dismissing the suit on the ground of waiver of notice and allow the suit and direct the respondent to vacate and hand over vacant possession of the shop to the petitioner, by allowing this Revision petition.
This CRP coming on for orders this day, the court made the following:
O R D E R Learned counsel for the petitioner has filed a memo dated 21.02.2019 stating that the petitioner and respondent have settled the matter out of Court. The respondent-tenant has handed over the vacant possession of the scheduled property to the petitioner on 18.02.2019. Hence, the petition does not survive for consideration.
2. In view of the submission of the learned counsel, memo is placed on record. Accordingly, the Civil Revision Petition is dismissed as settled out of Court as not pressed.
