Heard learned counsel for the parties.
Petitioner-Committee of Management Devi Rang Bahadur Singh Kavya Junior High School is before this Court with the request to command the respondent authorities to pay the arrears of salary to the teacher of the institution namely Smt. Suchita Yadav and Smt. Sarita Singh and in future regularly month to month salary may also be ensured.
Learned counsel for the petitioner apprised to the Court that the appointment of Smt. Suchita Yadav and Smt. Sarita Singh has been approved by the District Basic Education Officer, Jaunpur on 06.08.2010 and since then the Management is informing to the District Basic Education Officer regarding their continuance in the Institution and for ensuring salary to them but the salary has not been ensured to them till date. He has further informed to the Court that the Management has made a representation before the District Basic Education Officer, Jaunpur on 24.01.2018 and the same is still pending consideration before him and as such, it is requested that direction may be issued to decide the said representation at the earliest.
Learned Standing Counsel very fairly submits that in case any such representation is pending, the same would be decided by the concerned authority.
In view of the above, without entering into the merit of the case, the writ petition, on consent, stands disposed of directing the District Basic Education Officer, Jaunpur to consider and decide the representation of the petitioner by a reasoned and speaking order in accordance with law expeditiously, preferably, within six weeks from the date of receipt of certified copy of this order.
