The petitioner Committee of Management, by letter dated 16.11.2018, requested the District Inspector of Schools to accord permission to it to fill up a vacant Class III post in the Institution. The said post had fallen vacant consequent to retirement of clerk Ramayan Pandey. It was followed by a reminder dated 27.2.2019 and a direct communication sent to Director of Education (Madhyamic) dated 20.11.2018 and 4.3.2019. However, when no action has been taken in the matter, the instant petition has been filed.
Counsel for the petitioner submitted that the petitioner Committee of Management has got right to fill up the vacant post as per provisions of Regulation 101 of Chapter 3 of the Regulations framed under the U.P. Intermediate Education Act, 1921. He further states that prior permission of Director of Education is required before the post could be filled up.
Learned standing counsel appearing on behalf of the State respondents very fairly state that the respondent Nos. 2 & 3 will take necessary decision within such time, as may be directed by this Court.
Accordingly, the petition is disposed of with direction to respondent Nos. 2 and 3 to take appropriate decision in accordance with the provisions of Chapter III, Regulation 101, expeditiously, preferably within a period of ten weeks from the date of production of a certified copy of this order along with a fresh representation.
