Learned counsel for the petitioner submits that he may be permitted to delete petitioners no. 2 & 3 from the array of parties to the writ petition.
He is permitted to do so during the course of the day.
The petitioner runs an aided intermediate college, which is covered by the provisions of U.P. Intermediate Education Act, 1921. There are 12 posts of Class-IV in the institution and after redetermination of posts after Dhruv Narayan Singh's case, in 2013, 12 posts still remain sanctioned in the institution. Two posts have fallen vacant on account of retirement of two Class- IV employees. The petitioner has now forwarded the papers to the D.I.O.S. for permission to fill up these posts on 15.3.2019 as well as on 28.5.2019 and to the Director on 10.1.2019 and 20.5.2019, but neither the D.I.O.S. nor the Director has taken any decision.
The writ petition is disposed of with the observation that the D.I.O.S. as well as the Director will do the needful with regard to fill up the vacant posts if there is no other legal impediment and pass appropriate order in accordance with law within two months from the date a certified copy of this order is presented before them.
