C/M vs State Of U P And Others

High Court Of Judicature at Allahabad|30 September, 2019

JUDGMENT / ORDER

Court No. - 37
Case :- WRIT - A No. - 14676 of 2019 Petitioner :- C/M, Janta Inter College, Maharajganj, And 2 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Grijesh Tiwari Counsel for Respondent :- C.S.C.
Hon'ble Abhinava Upadhya,J.
Learned counsel for the petitioners prays that he may be permitted to delete petitioner no.3 in the array of the parties to the writ petition.
He is permitted to do so during the course of the day.
Heard learned counsel for the petitioners and the learned Standing Counsel appearing for the State- respondents.
The petitioner no.1 is the Committee of Management of an aided Intermediate College and petitioner no.2 is the Manager.
It is submitted that pursuant to the direction of this Court dated 16.1.2018 passed in Writ A No.1886 of 2018, the petitioners were granted permission to proceed for selection on Class-III posts. When the permission was granted, the petitioners advertised the post and made selection and thereafter forwarded the papers to the Regional Level Committee for financial sanction. However, the Regional Level Committee by its order dated 6.8.2019 declined to grant financial approval highlighting the irregularities in the advertisement as well as procedure adopted by the Institution for selection of Class-III Post.
By means of this writ petition the petitioners pray that they concede to the discrepancies in the selection process. However, they pray that they may be permitted to re-advertise the post and proceed with the selection in accordance with law without having to apply afresh for seeking permission from the Director.
In my view, no useful purpose would be served in keeping the writ petition pending further as a direction is being issued to the District Inspector of Schools to allow the petitioners to issue a fresh advertisement for filling up the vacancy earlier advertised in case there is no other legal impediment.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
