The present writ petition has been filed by the Committee of Management of the institution challenging the order dated 29.07.2020 passed by the District Inspector of Schools, Kushi Nagar disapproving the suspension order passed by the Management suspending the respondent no.4. The suspension order has been disapproved by the District Inspector of Schools on the ground that the petitioner had not produced the relevant document as referred in Regulation 39(1) of Chapter III of the Regulations framed under the Uttar Pradesh Intermediate Education Act-1921.
There is no illegality in the order dated 29.07.2020.
Apart from the aforesaid, the order does not adversely affect the Committee of Management and, therefore, it is not a fit case for interference by this Court in exercise of its extra ordinary jurisdiction under Article 226 of the Constitution of India.
The Committee of Management can proceed with the enquiry instituted against the respondent and complete the same expeditiously, in accordance with law.
The writ petition is dismissed.
