District Inspector of Schools, Kaushambi vide its order dated 6.2.2018 has approved promotion of one Smt. Gajala Iqbal, Assistant Teacher on the post of Lecturer in Economics and resultant vacancy was advertised in prominent news paper on 22.2.2018. It is alleged that the petitioner minority institution has proceeded to make appointment and thereafter papers have been forwarded for grant of financial approval but the District Inspector of Schools, Kaushambi is sitting tight over the matter, hence, this petition.
Learned Standing Counsel submits that the competent authority shall examine the grievance of the petitioner and shall pass an appropriate order, in accordance with law.
Considering the facts and circumstances, notices above, this petition stands disposed of with a direction upon respondent no.2 to accord consideration to the validity of petitioner's appointment, made by the petitioner committee of management to the post of Assistant Clerk, by passing a reasoned order in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
Needless to state that this Court has not adjudicating the legality of appointment and all such issues are left open to be considered by the authority concerned, at the first instance.
