Heard learned counsel for the parties.
The petitioner-Committee of Management is before this Court for a direction to third respondent i.e. District Basic Education Officer, Meerut to consider the case of the petitioner with regard to grant of prior permission for start the selection process on two posts of Class-IV in petitioner's institution by passing appropriate order within stipulated period.
Learned counsel for the petitioner submits that in similar circumstances this Court in Writ-A No.412 of 2018 (C/M Varun Singh Asmarak Inter College v. State of U.P. & Ors.) relying on the decision in Committee of Management, Nehru Kissan Vidyalaya Junior High School v. State of U.P. & Ors., 2017 (3) ADJ 503 has passed a positive order on 8.1.2018 and as such the similar direction may also be passed in this writ petition also.
Learned counsel for the respondents submits that the third respondent i.e. District Basic Education Officer, Meerut shall pass appropriate order in terms of the decision in C/M Nehru Kissan Vidyalaya Junior High School (Supra).
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the third respondent i.e. District Basic Education Officer, Meerut to consider and decide the claim of the petitioner by a reasoned and speaking order expeditiously and preferably within six weeks from the date of filing of the certified copy of this order.
