Heard learned counsel for the petitioners and learned Standing Counsel.
The petitioners-Committee of Management is before this Court for a direction to second respondent i.e. Director of Education, Secondary, U.P. at Lucknow to grant permission for filling up the vacant post of clerk in the institution in question forthwith.
Learned counsel for the petitioners states that there is one sanctioned post of Class-III employee in the institution in question, which has been redetermined by Government Order dated 29.5.2013 pursuant to order dated 22.6.2012 passed by this Court in Writ Petition No.26307 of 2010 (Dhruv Narayan Singh v. State of U.P. & Ors.) and the same is lying vacant on account of retirement of regular clerk on 30.06.2014. As such direction may be issued to the respondents to grant permission for filling up the said post.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the second respondent to look into the grievance of the petitioners and pass appropriate order in accordance with law expeditiously and preferably within two months from the date of production of certified copy of this order.
