It is contended by Sri Bheem Singh, learned counsel appearing on behalf of the petitioner that there are three posts in the institution and the reservation is not applicable up to three posts, hence, the impugned order passed by the District Inspector of Schools is unsustainable. He has also submitted that the interim order passed by this Court in writ petition no. 4589 of 2009 in no way say to provide reservation. He further submits that in this regard he has filed an objection before the District Inspector of Schools but without passing any order on the same the District Inspector of School is threating to take action against the Committee of Management.
In view of that, put up this matter as fresh on 12th July, 2010. Till then District Inspector of Schools is directed to not to take coervice action against the Committee of Management and pass an appropriate order on the objection filed by the petitioner and brought it on record and by way of filing counter affidavit.
Learned Standing counsel is directed to inform this order to the District Inspector of Schools, Gautam Budh Nagar.
