Heard Shri Anil Bhushan, learned Senior Counsel assisted by Shri Ram Sajivan Tripathi, learned counsel for the petitioners and learned Standing Counsel for the respondents.
Present Writ Petition under Article 226 of the Constitution of India has been filed seeking direction to the respondents to reimburse the tuition fee of the students of D.Pharma and further the prayer was made for deciding the representation of the petitioners dated 2.12.2019.
Learned counsel for the petitioners submits that the petitioners are the students pursuing diploma in Pharmacy from the college of the petitioner No.1 namely, Unnati Pharmacy College, Farah, District Mathura and as per the Government Order dated 2.7.2019, tuition fees has to be reimbursed in the bank accounts of the students. It is further provided in the said Government Order that in case students belong to the S.C. Category, then reimbursement is to the extent of 100 percent and if the students belong to O.B.C./reserved categories, then reimbursement is to the extent of 50 percent. It is further submitted by learned counsel for the petitioners that all the formalities have been completed by the petitioners-students, but the tuition fees has not been reimbursed in their accounts. Learned counsel for the petitioners further submits that the representation dated 2.12.2019, appended as Annexure-7 to the Writ Petition, has been filed before the Director, Social Welfare Department, Government of Uttar Pradesh, Lucknow, respondent No.2, which remained undecided till date.
No useful purpose will be served by keeping the Writ Petition pending and by calling the counter affidavit. Under the facts and circumstances of the case, Director, Social Welfare Department, Government of Uttar Pradesh, Lucknow, respondent No.2 is directed to look into the matter and pass appropriate order on the representation of the petitioners-students dated 2.12.2019 as expeditiously as possible, preferably within a period of one month from the date of production of a certified copy of this order before him.
