Heard learned counsel for the parties.
The challenge is to the order dated 15.10.2010 whereby the recognition granted to the petitioner institution has been withdrawn on the ground that the institution has failed to fulfil the terms and conditions that were prescribed in the recognition orsel for the petitioner submits that the petitioner is prepared to remove the deficiencies and then approach the competent authority before whom the matter may be remitted for consideration afresh.
Learned standing counsel submits that this option is open to the petitioner provided the petitioner removes the deficiencies and moves an application in terms of the Regulation 13(Ga) of Chapter VII of the Regulations framed under the U.P. Intermediate Education Act, 1921 which runs as follows:

In the event the petitioner complies with the terms and conditions and removes the deficiencies as pointed out, in that event the respondent board shall re-consider the claim of the petitioner for restoring the recognition in accordance with the aforesaid regulation provided the deficiencies are removed within a period of one month from the date of production of a certified copy of this order before it.
The writ petition is disposed of.
