This writ petition has been filed challenging the impugned order dated 24.7.2021,whereby the election observer has kept the election process in abeyance due to pendency of Writ-C No.12203 of 2021 before this Court.
Mr. V. K.Singh, learned Senior Counsel assisted by Chandrachud Pandey, learned counsel for the petitioners has placed on record the order dated 19.8.2021, passed in the aforesaid writ petition whereby the writ petition is dismissed in default and he submits that the very basis of the impugned order is presently not in existence, therefore, this order be set- aside.
Shri. R.K.Ojha, learned Senior Counsel assisted by Shailendra Kumar Sharma, Advocate submitted that he wants to file impleadment application.
At this stage, there is no need to permit to file impleadment application, which has not been yet filed in the Registry.
Considering that the very basis of the impugned order i.e. pendency of Writ-C No.12203 of 2021 before this Court is presently not available as the said writ petition has already been dismissed in default on 19.8.2021, therefore the impugned order dated 24.7.2021 and any consequential order passed thereon are set-aside and the election observer is directed to proceed with the proposed election in accordance with law.
Accordingly, this writ petition is allowed.
