Petitioner Committee of Management has made a request on 29.10.2018 for grant of permission to fill up one post of Class-
III employee in the institution by virtue of Regulation 101 framed under Chapter-III of the U.P. Intermediate Education Act, 1921. It is stated that one of the Class-IV employees has been promoted to the post of Senior Clerk, and therefore, one post of Assistant Clerk has fallen vacant. Submission is that by virtue of regulation 101 framed under Chapter-III of the U.P. Intermediate Education Act, 1921, the Inspector is required to transmit relevant details/facts to the Director and thereafter grant permission, but despite repeated letters sent no decision is being taken in the matter.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, annexing relevant details/facts in respect of existing vacancy against class III post, alongwith certified copy of this order, within a period of two weeks from today. In case such a claim is raised, the Inspector shall act strictly in terms of regulation 101 and after seeking appropriate permission from the Director concerned, he shall pass appropriate orders within a further period of three months thereafter.
