Heard learned counsel for the parties.
The petitioners have preferred the present writ petition with the following prayers:-
" It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to issue :
i. a writ, order or direction in the nature of certiorari quashing the impugned order dated 15.11.2018 (Annexure no.10 to this writ petition) passed by the District Basic Education Officer, Maharajganj as well as the impugned Government Order dated 15.1.2019 (Annexure no.12 to this writ petition) passed by the State Government.
ii. a writ, order or direction in the nature of mandamus commanding the respondent authorities to grant permission to the petitioner Committee of Management to fill up the post of Assistant Clerk in the institution in question."
The court is of the view that aforesaid relief could not be granted unless the counter affidavit is called for from the respondents.
Learned Standing Counsel has accepted notice on behalf of respondent nos.1 to 3. Mr. Shere Ali, learned counsel, has accepted notice on behalf of respondent no.4.
Counter affidavit be filed by all the respondents within four weeks. Rejoinder affidavit may be filed within two weeks' thereafter.
