The present petition has been filed for a direction upon the respondent no.1 (Principal Secretary, Basic Education, U.P. at Lucknow) to consider the recommendation made by the District Basic Education Officer, Fatehpur to include the petitioner's institution on the grant-in-aid list.
The case of the petitioners is that the prayer for including the petitioner's institution on the grant-in-aid list is pending consideration before the first respondent and, till date, no decision has been taken on the same and, therefore, it has been prayed that a direction be issued to the first respondent to take decision on the same in accordance with law within a specified period.
Considering the nature of the prayer of the petitioners, without expressing any opinion on the merits of the claim of the petitioners, this Court considers it appropriate to dispose of this petition by giving liberty to file a comprehensive representation annexing therewith previous application for including the petitioner's institution on the grant-in-aid list along with relevant documents. If any such representation is filed along with certified copy of this order before the first respondent, the first respondent shall call for report from the concerned authority and, after examining the record and verifying the facts from the record, shall take appropriate decision thereon, preferably, within next two months.
With the aforesaid liberty/direction, the petition stands disposed of. Order Date :- 28.2.2018 Sunil Kr Tiwari
