This appeal is directed against the order passed by learned Single Judge dated14.06.2010 by which, writ petition challenging the order passed by Regional Education Committee-XIIth Region, Moradabad headed (respondent no.2) has been dismissed.
Submission is that election of the committee of management took place under the supervision of the Observer so appointed by the District Inspector of Schools and it is thereafter, in view of latest government order, the District Inspector of Schools attested the signature of newly elected Manager by the order dated 27.02.2010 and although there was no rival claim/committee but on the complaint of certain persons without any proper opportunity and on totally wrongly premises, the order was passed by respondent no.2 by which fresh election is directed.
In view of above, matter needs to be decided after getting response from the respondents.
Issue notices to respondent no. 4 to 6, steps for which may be taken within ten days.Respondents no. 1 to 3 are represented by learned Chief Standing Counsel. Counter affidavit may be filed by the next date.
List this matter in August, 2010.
On the facts, this Court directs as an interim measure that till the next date of listing, operation of the order dated 14.05.2010 passed by respondent no.2 shall remain stayed.
