Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 and 2 and Sri Prabhakar Awasthi, learned counsel for respondent no. 3.
The present petition has been filed for decide the representation of the petitioner no. 2 dated 3.11.2018 for cancellation of the registration of the society established by respondent no. 3.
Learned Standing Counsel as well as Sri Prabhakar Awasthi, learned counsel for respondent no. 3 has raised preliminary objection with regard to maintainability of writ petition on the ground of alternative remedy to file appeal before Registrar under section 12D of Societies Registration Act, 1860 (hereafter referred to as "Act, 1860"), which could not be disputed by learned counsel for the petitioners.
Accordingly, this petition is dismissed on the ground of alternative remedy with liberty to petitioners to approach the Registrar by filing appeal under section 12D of the Act, 1860, if so advised.
