Committee of Management of the institution is before this Court seeking a direction to the District Inspector of Schools to grant permission to fill up the post of Assistant Clerk. Such application of the petitioner has remained pending with the District Inspector of Schools, Varanasi, and no orders have been passed, on account of which the petitioner has approached this Court.
Regulation 101 of the Regulations framed under Chapter III of the U.P. Intermediate Education Act, 1921 provides for the procedure by which permission is to be granted for filling up the Class-III post. The Inspector is expected to supply correct facts to obtain permission from Director, whereafter the Committee of Management can be permitted to fill the post.
Since the petitioner has already approached the District Inspector of Schools in that regard, it would be appropriate to direct the respondent no.3 to consider the claim of petitioner for grant of permission to fill up the post in accordance with Regulation 101. The required consideration shall be made within a period of three months from the date of presentation of certified copy of this order.
Writ petition is, accordingly, disposed of.
