Committee of Management of Sri Gandhi Uchchatar Madhyamik Vidyalaya, Etawah has approached this Court by filing the present writ petition with the grievance that though vacant positions on the post of Assistant Teacher and Class IV has come into existence since long, but despite repeated letters sent, the District Basic Education Officer, Etawah has not accorded permission to fill up the post. Submission is that in terms of rule 7(1) of the Rules of 1978, the concerned authority is required to examine the request of petitioner, but no consideration has been accorded.
Learned counsel representing respondent no.2 submits that petitioner's grievance shall be examined and appropriate order would be passed, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.2 in respect of its grievance, noticed above, alongwith certified copy of this order, within a period of two weeks from today. Petitioner shall be at liberty to place all relevant materials in support of its case. In case such a claim is raised, the same shall be examined by the authority concerned, by means of a reasoned order to be passed, in accordance with law, within a further period of two months thereafter.
