Heard learned counsel for the petitioner-committee of management.
After examining Rule 7 of the U.P. Recognised Schools (Junior High School) Recruitment and Other Conditions of Teachers Rules, 1978, the learned counsel fairly stated that the Rules 7(2) of the Rules has not been complied with strictly while making the advertisement. Therefore, this Court finds no good ground to interfere with the oreder of the Basic Shiksha Adhikari dated 1.2.12 refusing to appoint his nominee to the Selection Committee.
The writ petition is dismissed with a liberty to the petitioner to publish a proper advertisement in accordance with law and, thereafter, to ask the Basic Shiksha Adhikari to appoint his nominee. If this is done, the Basic Shiksha Adhikari shall appoint a nominee in accordance with law at the earliest.
