Heard counsel for the petitioners, learned standing counsel for respondents no.1 & 2 and Sri Nitinjay Pandey for respondent no.3. With their consent, the instant writ petition is being disposed of without inviting a formal counter affidavit.
The petitioners have prayed for issuance of a mandamus commanding respondent no.2, Deputy Registrar, Firm, Societies and Chits, Agra to register the list of office bearers with petitioner no.2 as its Manager in exercise of power under Section 4 of the Societies Registration Act, 1860 and for a further direction to register list of General Body under Section 4-B.
Sri Nitinjay Pandey, learned counsel appearing on behalf of respondent no.3 does not dispute that on basis of claim submitted by the petitioners, respondent no.2 has already drawn proceedings and is in the process of hearing the claim. He, therefore, has no objection in case a direction is issued to respondent no.2 to decide the same within time frame.
Accordingly, the instant writ petition is disposed of by directing directing respondent no.2 to decide the matter relating to registration of list of office bearers and members of General Body within a period of twelve weeks from the date of production of a certified copy of this order, after due notice and opportunity of hearing to respondent no.3 or to any other person likely to be affected thereby.
