Heard learned counsel for the parties.
The petitioner committee of management before this Court seeks the benefit of grant-in-aid of the State Government for the primary school being run by it on the premise of right of children to free and compulsory education as policy and objective of the State Government to boost up the elementary education in the State.
Learned counsel for the petitioner has placed reliance upon the judgment of the Supreme Court in the case of State of U.P. and Others v. Pawan Kumar Divedi (2014) 9 SCC 692 and further division bench judgment of this Court in the case of Paripurna Nand Tripathi And Anr. vs State Of U.P. And 20 Others, 2015 (3) ADJ 567 in which the Court had directed for the consideration for grant-in respect of the institution in the category of primary and junior high school. The petitioner has already moved the application in this regard before respondent no. 1.
In view of above, let application of the petitioner be considered strictly in accordance with law after due verification of records if in the opinion of the State, the petitioner comes within the eligibility criterion fixed/prescribed by the State for allocating grant for such institutions. The decision shall be taken by the respondent either way within period of three months from the date of production of certified copy of this order.
Writ petition stands disposed of with the aforesaid observations.
