It is contended that respondent no. 4 is facing criminal charges under sections 419, 420, 467, 468 and 471 IPC in Case Crime No. 132 of 2009, PS Bela, District Auraiya, wherein charge-sheet has also been filed. It is further stated that he was confined to prison pending investigation and has now been released on bail. Such a person is completely unfit to be permitted to resume the duties till he is not acquitted of the criminal charges, involving moral turpitude.
In view of the above, the petitioner has made a case for grant of interim order.
Till the next date of listing, the operation of the order of the DIOS dated 19.3.2012 shall remain stayed.
