The Committee of Management of Sahid Captain V.P. Singh and the Sahid V.P. Singh Shiksha Samiti have filed this petition for a direction upon the respondent-Northern Regional Committee, National Council for Teacher Education to modify the recognition granted on 22nd December, 2009 by granting recognition to the petitioners-Institution for B.Ed. course with effect from 2008-2009 instead of 2009-2010.
It is the contention of Sri P.S. Baghel, learned Senior Counsel for the petitioners that the petitioners had filed an application before the Committee for granting recognition in January, 2008 after completing all the formalities and since in the State of Uttar Pradesh, admissions are still going on for the academic session 2008-09 and the State Government has declared the session 2009- 10 as a 'Zero' session, the Committee should have granted recognition to the College with effect from 2008-09. He further points out that in similar circumstances, Committee of Management, Seth Srinivas Agarwal Institution of Management filed Writ Petition No. 65087 of 2009 which was disposed of by the judgment and order dated 2nd December, 2009 giving liberty to the petitioner to approach the Committee for granting recognition with effect from 2008-09.
Having heard Sri P.S. Baghel, learned Senior Counsel for the petitioners and Sri R.A. Akhtar, learned counsel appearing for respondent, the petition is disposed of with a direction that in the event the petitioners file a certified copy of this order before the Committee within a period of two weeks' from today, the respondents shall pass an appropriate order expeditiously.
It is made clear that this Court has not adjudicated upon the merits of the case which shall be considered by the Committee in accordance with law.
