Heard Sri Hritudhwaj Pratap Sahi, learned counsel appeared on behalf of the petitioners, Sri Y.S. Bohra, learned counsel representing the respondent no. 3 and learned Standing Counsel for the respondent nos. 1 and 2.
With the consent of the counsels for the parties, the writ petition is disposed of.
The sole submission of the counsel for the petitioner is to issue a mandamus to the respondent no. 3, District Basic Education Officer, Aligarh to send his nominee to oversee the selection process on the post of Head Master in the institution, namely Sarvhitkari Junior High School, Maur District Aligarh through its Manager Jang Bahadur Singh.
Learned counsel for the petitioners has placed reliance of the provision of Rule 9 of the Uttar Pradesh Recognized Basic Schools (Junior High Schools) (Recruitment And Conditions of Service of Teachers) Rules, 1978. The said Rules provides the procedure for consideration of selection committee.
In view of the aforesaid, this Court directs the respondent no. 3 to send his nominee within a period of one month from the date of production of certified copy of this order for selection process on the post of Head Master in the petitioners' institution.
The writ petition is disposed of.
