By order dated 20.12.2017 passed in Writ-A No.57080 of 2017, a direction was issued to District Inspector of Schools, Kushinagar to pass a fresh order on the proposal relating to suspension of the Principal of the institution within a period of six weeks from the date of receipt of certified copy of the order.
Since despite service of notice upon the opposite party in the instant contempt proceedings, he did not appear, therefore, by order dated 5.7.2018, bailable warrant was issued. In pursuance thereof, the opposite party is present before this Court. He has filed an affidavit of compliance stating that he has already taken a decision in terms of the direction issued by the Writ Court. A copy of the decision taken by him dated 11.5.2018 has been brought on record.
Since the order of the Writ Court has been complied with, therefore, there is no good ground to proceed any further in the instant matter. The notice issued to the opposite party stands discharged.
The contempt application is consigned to record.
