The sole relief claimed in the instant writ petition is for issuance of a mandamus commanding District Inspector of Schools, Jhansi to provide an observer for supervising holding of election of Committee of Management of Sri Sanatandharm Kanya Inter College, Sipri Bazar, Jhansi.
The petitioner claims itself to be duly elected Committee of Management of the institution. It is the specific case of the petitioner that its election was recognised by District Inspector of Schools by order dated 15.1.2013 and in pursuance thereof, it continued to manage the affairs of the institution. The petitioner Committee of Management has sent a letter on 28.1.2018 to the District Inspector of Schools to appoint an observer. On 13.2.2018, the District Inspector of Schools raised certain objections. Those objections, it is claimed, were removed by submitting reply on 27.2.2018. Thereafter, there was further exchange of communication between the Committee of Management and District Inspector of Schools, but no final decision has been taken by District Inspector of Schools so far and hence, the instant writ petition.
The scheme of administration as enclosed with the writ petition specifically provides that the election of the Committee of Management would be held in the presence of observer appointed by District Inspector of Schools.
Having regard to the said fact, this Court is of the opinion that District Inspector of Schools should pass an order one way or the other in respect of the prayer made by the petitioner Committee of Management.
Accordingly, the writ petition is disposed of by directing respondent no.4 to pass a speaking order on the request made by the petitioner Committee of Management for appointing an observer within a period of four weeks from the date of production of a certified copy of this order, after hearing all concerned parties.
