The instant writ petition has been filed seeking a mandamus commanding respondent no.3 to grant affiliation to the petitioner institution for running two years D.El.Ed. Course for academic year 2018-19.
The petitioner Committee of Management of S.L. Rajendra Institute of Higher Education, Alipur, Mau filed Writ-C No.12181 of 2018 challenging order dated 30.5.2017, whereby the Secretary, Examination Regulatory Authority, Allahabad communicated to the petitioner the decision of the State Level Committee declining grant of affiliation to the institution.The said writ petition was disposed of with the following observations :-
"Having regard to the submission, the instant petition is disposed of by providing that in case the petitioner applies for affiliation for the next academic session, the same shall be considered independently on the basis of the documents as may be annexed with the said application and without being influenced by the impugned order."
It seems that thereafter the petitioner filed an application before respondent no.3 on 13.4.2018 alongwith which order of this Court dated 9.4.2018 was filed. The prayer made in the application was for taking necessary action as directed by this Court. Since the application remained pending and therefore the instant writ petition has been filed.
Sri M.N. Siddiqui, learned standing counsel appearing on behalf of the respondents, on instructions, states that the petitioner Committee of Management has not filed application in proper format as prescribed for seeking affiliation, but merely an application stating that its request for affiliation be considered as directed by this Court. It is submitted that until a proper application is filed alongwith the requisite documents, it would not be possible to ascertain the claim of grant of affiliation.
Counsel for the petitioner states that the petitioner would file formal application and same may be directed to be considered.
Learned standing counsel states that in case any application is now filed, it would be considered only for the next academic year.
The writ petition is disposed of by providing that in case petitioner Committee of Management files a fresh application in prescribed format, as per time schedule, it would be considered in accordance with law.
The writ petition stands disposed of accordingly.
