1. Heard Sri S.K.Chaubey, learned counsel for appellant and learned Standing Counsel for respondents 1 to 5.
2. This intra-Court appeal under Chapter VIII Rule 5 of Allahabad High Court Rules, 1952 (hereinafter referred to as "Rules, 1952") has arisen from judgment dated 22.01.2019 passed by learned Single Judge dismissing appellant's writ petition no.24 of 2019.
3. Appellant has claimed that it must be selected and nominated as Examination Center to conduct High School and Intermediate Examination conducted by Board of High School and Intermediate Education, Allahabad. Learned Single Judge has found that no educational institution has any right to get itself nominated as Examination Center and this is within the domain of selection body and for such nomination, writ petition is not maintainable.
4. Learned Single Judge while expressing this view has followed earlier Division Bench judgment of this Court in Special Appeal No.118 of 2011, C/s Shaheed Mangal Pandey Inter College, Meerut and others vs. State of U.P. and others decided on 27.01.2011.
5. We do not find any reason to take a different view than what has been expressed by another Division Bench of this Court in the above decision. We, therefore, do not find any fault in the judgment passed by learned Single Judge warranting interference.
6. Appeal is accordingly dismissed.
