JUDGMENT / ORDER

The petitioner is challenging the notice dated 17.1.2012 issued by respondent no. 4 asking the petitioner to appear in an inquiry relating to the complaint made by the District Magistrate, Firozabad.
Learned counsel for the petitioner submitted that the administrative authority or the police has no jurisdiction to make any inquiry.
I find substance in the argument of learned counsel for the petitioner, which requires consideration.
Learned Standing Counsel appears on behalf of respondent nos. 1, 3 and 4 and Sri Sanjai Kumar Singh, Advocate appears on behalf of respondent no. 2. All the respondents may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further order of this Court, the proceeding in pursuance of the notice dated 17.1.2012 issued by respondent no. 4, Annexure-1 to the writ petition, shall remain stayed.
