By means of this writ petition, the petitioner has prayed for a direction to the authorities to allow the petitioner to fill up the Class-III post in the Institution. The procedure for filling up the Class-III posts is provided under Regulation 101 Chapter III of the Regulations framed under the U.P. Intermediate Education Act, 1921. The detailed procedure has been prescribed that before granting any permission for filling up the said post, the District Inspector of Schools will ascertain the necessity of the post to be filled up considering the student's strength in the Institution and if he finds that the vacancy is required to be filled up, then he shall recommend to the Director of Education and thereafter, the Director of Education considering the proposal of the D.I.O.S. will pass appropriate orders.
In this case, the Committee of Management has already requested the D.I.O.S. to do the needful and the request of the Committee of Management was forwarded to the D.I.O.S. on 1.5.2017 but till date, no action has been taken.
The writ petition is disposed of with the direction to the respondent No.4-District Inspector of Schools, Ballia to consider the claim of the petitioner and start the procedure as prescribed under Regulation 101 Chapter III of the Regulations framed under the U.P. Intermediate Education Act, 1921.
