By means of instant writ petition, the petitioners have called into question a communication by Registrar of the University dated 26.2.2018 by which the Principal/Manager of the institution has been informed about the decision of the Vice Chancellor according approval to the Managing Committee headed by Indu Jain in exercise of power under Section 2 (13) of the U.P. State Universities Act, 1973.
After some argument, counsel for the petitioners submitted that the petitioners would challenge the impugned order before the Chancellor by seeking reference. It is prayed that reference may be directed to be decided within a time frame.
Learned standing counsel appearing on behalf of State respondents and Sri Vivek Verma, learned counsel appearing on behalf of respondent University has no objection to the same.
Accordingly, the instant writ petition is disposed of with liberty to the petitioners to seek reference under Section 68 of the Act. In the event, any such reference is made, it is desirable that the same be decided in accordance with law, after due notice and opportunity of hearing to respondent no.5, preferably within a period of next three months.
