It is stated that since there is no class IV employee eligible for promotion to the post of Assistant Clerk, which has fallen vacant due to retirement, therefore, petitioner institution has approached the District Inspector of Schools to grant permission to fill the post in question in the institution by direct recruitment, but no decision has yet been taken. The authority concerned is required to act in terms of regulation 101 of the Regulations framed under the U.P. Intermediate Education Act, 1921 and after obtaining necessary permission from the Director, the authority concerned has to pass needful orders.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent nos.2 and 3 to accord consideration to petitioner's claim, in terms of the regulation 101, by means of a reasoned order to be passed, within a period of three months from the date of presentation of certified copy of this order. The authorities concerned shall also examine the aspect relating to eligibility of class IV employee for being considered for promotion.
