The petitioner is challenging the order dated15.5.2010 passed by Deputy Registrar, Regional Office Firms, Societies and Chits declaring the election programme for holding elections of Ram Katori Smarak Kanya Junior High School, Sadullapur Lodi, District- Ghaziabad.
Learned counsel for the petitioner has contended that the last elections were held on 26.4.09 which were duly recognized by DIOS on 23.5.09. The said elections were also registered under section 4 of the Societies Registration Act on 9.11.09. Therefore, there is no justification for directing or declaring fresh election programme.
Sri N.L. Pandey, learned counsel for the respondent no. 4 as well as learned Standing counsel who has accepted notice on behalf of respondent no. 1,2 and 3 pray for and are allowed three weeks' time to file counter affidavit. One week thereafter is allowed to the petitioner to file rejoinder affidavit.

The election if any held as per the programme declared, shall be subject to the decision of this writ petition.
