Heard Sri Ramesh Chandra Dwivedi, learned counsel for the petitioner and learned Standing Counsel for the respondents.
Sri R.C.Dwivedi, learned counsel for the petitioner contends that the application for renewal of registration of the petitioner's society is pending before the respondent No.2. His only prayer is that the application for renewal may be decided within a stipulated period of time.
Learned Standing Counsel for the respondents submits that the matter relates to renewal of the registration of the society which needs verification of various facts including the validity of the membership of the petitioner no.2 and his locus standi to maintain such application. However, he fairly submits that the competent authority to decide such issues is the respondent No.2.
No useful purpose will be served by keeping the writ petition pending.
The respondent No.2 is directed to decide the application for renewal of the registration of the petitioner's society expeditiously, preferably, within a period of three months from the date of receipt of a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind after due verification of various aspects including the locus standi of the petitioner to file such application, validity of his membership and so on.
With the aforesaid direction, the writ petition is disposed of.
