Heard Sri Vivek Kumar Singh, learned counsel for the petitioner, Sri Santosh Kumar Singh, learned counsel for respondent no.3 and learned standing counsel for the respondent nos 1 and 2.
The petitioner in the writ petition is seeking a direction to the respondent no.2 Director of Education (Basic) U.P., Nishatganj, Lucknow to pay the salary of the teachers who are working in the petitioner's institution, which has already been taken on grant-in-aid list. The petitioner no.1 is the Committee of Management Railway Settlement notified area Junior High School and the petitioner no.2 is the Manager of Committee of Management of the said Institution.
It is stated that the Institution was brought on grant-in-aid list, a copy of which is annexed as Annexure-13 to the writ petition, and therefore, the teachers of the petitioner's institution are eligible for payment of salary by the State Government but till date salary has not been paid to the teachers by the State Government. In this regard the Manager of the Committee of Management of the College had sent a letter to the Additional Chief Secretary (Basic), Lucknow on 2.2.2018 a copy of which has been filed as Annexure 17 to the writ petition but till date no order has been passed.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.2 Director of Education (Basic) U.P., Nishatganj, Lucknow, U.P. to take a decision with regard to the payment of salary of the teachers in light of the observations made above, in accordance with law, expeditiously preferably within a period of three months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioners on merit.
