Learned counsel for the petitioners submitted that the petitioners are running a recognised Institution / Junior High School in the name of R.P. Janta Purv Madhyamik Vidyalaya, Hardia Chauraha, Basti. The petitioners wishes to shift to its own building in the same locality at Hardia Chauraha, but at Raipura in district Basti.
The petitioners have informed the Basic Shiksha Adhikari, Basti that the land has already been purchased by the petitioners Institution through a registered sale deed and the Institution is now running on its own land and building over plot no. 180 Raipura, Basi, but the recognition is still in the name of R.P. Janta Purv Madhyamik Vidyalaya, Hardia Chauraha, Basti. An application was made for change of name to refer the Institution Raipura Basti. This application is still pending with no decision taken thereon.
I have heard the learned counsel for the petitioners and Sri Awadhesh Kumar, learned counsel for the BSA. He has no objection if the writ petition is disposed of at the admission stage itself with a direction to the BSA to consider and decide the pending application of the petitioners in accordance with law.
Accordingly, this writ petition is disposed of with a direction to the respondent no. 2 to consider and decide the application said to be pending before him by a reasoned and speaking order within a period of four weeks from the date a certified copy of this order is produced before him.
