This writ petition has been filed, inter alia, for the following reliefs:-
"(i). Issue a writ of mandamus directing the respondents not to pass any high-tension power supplyof electricity of 33000 volt adjacent to the institution known as R.G. Mahavidhalaya, Shivali Road, Baghpur, Kanpur Dehat situate in Aarazi no. 1863, Khata No. 65, area 1.0940 hectare situate in village Baghpur, Tehsil Maitha, District Kanpur Dehat.
Heard Sri P.S. Yadav, learned counsel for the petitioners, Sri S.K. Yadav, learned counsel for the respondent-corporation, learned Standing Counsel for respondent no. 1 and perused the record.
Having regard to the nature of the grievance, we are of the firm opinion that the same would fall within the competence/ domain of the authorities under the Works of Licensees Rules, 2006, which have been framed under the Electricity Act, 2003.
Consequently, we permit the petitioners to move the Collector/District Magistrate, Kanpur Dehat with a copy of their claim together with a certified copy of this order and place such materials as the petitioners may seek to rely upon. The Collector/ District Magistrate, Kanpur Dehat shall take a final decision on the application preferably within a period of three months of the receipt of a copy of the application.
The petition is, accordingly, disposed of.
