Heard Sri Prabhakar Awasthi, learned counsel for the petitioners and Sri K.S. Kushwaha, learned counsel assisted by Sri Sanjay Kumar Singh Kushwaha, learned counsel for the respondent no. 5.
The only prayer made by Sri Prabhakar Awasthi, learned counsel for the petitioners is that a post decisional hearing may be given to the petitioner by the competent authority and that the competent authority should apply its mind to the reply submitted by the petitioners.
Learned Standing Counsel calls attention to the findings of the authority in the impugned order and contends that the educational institution lacks basic infrastructure including toilet which is hampering the education and enlightening the future of the students.
Interest of justice will be served by remitting the matter to the Additional District Magistrate (City) Varanasi, to execute the following directions:
(1) The Additional District Magistrate (City) Varanasi, shall personally cause an inspection of the educational institution to be conducted in the presence of the petitioner within a period of one month from today. The entire inspection shall be videograhed and photographs shall also be taken.
(2) The petitioner shall be issued a show cause notice thereafter.
(3) The petitioner shall submit his reply within a period of fifteen days from the issuance of such show cause notice.
(4) The controversy shall be decided by a reasoned and speaking order within a period of five months from the date of production of a computer generated copy of this order downloaded from the official website of the High Court of Judicature at Allahabad.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
The impugned order shall abide by the final order passed by the competent authority in pursuance of the directions issued in this case.
The writ petition is disposed of.
