Petitioner no. 1 is a Committee of Management and has sought permission to fill up Class-III post by direct recruitment.
It is submitted that there are four sanctioned posts of Class-III in the institution out of which two posts have been occupied by promotees namely, Smt. Sangeeta Singh and Shri Chandra Shekhar Upadhyay and the post of Head Clerk is occupied by Shri Chandra Prakash Tiwari and for one post that is to be filled under direct recruitment quota the petitioners have sought permission from the Director through the D.I.O.S., but no action has been taken.
The writ petition is disposed of with the observation that the D.I.O.S., Kushinagar will verify the nature of vacancy to be filled in Class-III post and thereafter if he finds that the said post is to be filled by direct recruitment, will forward the papers to the Director of Education (Secondary), who will pass appropriate order in accordance with law within two months thereafter.
