Heard counsel for the petitioners and learned standing counsel appearing for the State respondents.
By means of the present petition under Art. 226 of the Constitution, the petitioners seek a direction in the nature of mandamus commanding the respondents to declare the petitioner-institution as an examination centre for the ensuing High School and Intermediate Board Examinations 2020-21 in view of the recommendation made by the Chairman,District Level Committee, Mau, within some specified period.
Learned counsel for the petitioners submits that the petitioner- institution had applied for making the institution in question as an examination centre for the ensuing Board Examination 2020-
21 and the name of the petitioner-institution was also recommended by the District Level Committee, Mau vide its letter dated 7.12.2019 (Annexure-5) clearly mentioning therein that due to inadvertent mistake the name of petitioner- institution was left to be included in the list of examination centres. Inspite of that, in the final list declared of examination centres, name of the petitioner-institution does not find place. It is further submitted by the learned counsel for petitioners that petitioner has represented the matter to the respondent no. 2- Secretary, Board of Secondary Education,U.P. Prayagraj on 2.12.2019 vide annexure-4 to the writ petition but no decision thereon has been taken so far.
After hearing learned counsel for the petitioners, learned standing counsel and perusing the record, the present writ petition is being finally disposed of by issuing a direction to the respondent no. 2- Secretary, Board of Secondary Education,U.P. Prayagraj to consider and decide the petitioner's representation dated 2.12.2019 ( annexure-4 to the writ petition) in accordance with law expeditiously,if possible, within a period of three weeks from the date of production of a certified copy of this order.
No order as to costs.
