Heard learned counsel for the petitioner, learned Standing Counsel for the State/respondent and Sri R.B.Pradhan, learned counsel for respondent no. 4.
The petitioner claims to be the committee of management of Panchsheel Laghu Madhyamik Vidyalaya, Rukundipur, Post Nunahara, District Ghazipur and seeks to make regular selection and appointment on the post of Headmaster under U.P. Recognized Basic Schools (Junior High Schools) Recruitment and Conditions of Service of Teachers) Rules, 1978 on account of existing vacancy of the Headmaster.
It is claimed that Committee of Management, came to be recognized within attestation of the signatures by District Inspector of Schools on 31st March, 2016. The committee of Management as per the rules adopted resolution on 15.4.2018 to fill up the vacant post of headmaster and accordingly the application was forwarded on 20th April, 2018 alongwith aforesaid proposal to the District Basic Education Officer, namely 4th respondent seeking prior permission in the matter of selection and appointment on the post of headmaster.
The contention of learned counsel for the petitioner is that ever since the resolution has been passed in the matter and application has been forwarded to the 4th respondent, he has not taken any decision in the matter and hence the writ petition.
Without going into merits of the of the case and avermnets advanced on behalf of the parties and rights and entitlement of the Committee of Management for making appointment on the post of headmaster, at this stage writ petition is disposed of with direction to respondent to consider the application of the petitioner dated 20th April, 2018 served in the office of 4th respondent on 23rd April, 2018 and pass appropriate orders within period of six weeks from the date of production of certified copy of this order.
